In an unexpected move, a Texas court issued a new ruling earlier this month in the case of a nonbiological lesbian mom suing her ex-partner for visitation rights to their child. Nancy Polikoff informs us that this new ruling reverses that of a lower court, which had previously found that the non-bio mom had no right to bring any action for custody or visitation.
Now, Nancy tells us, “The nonbio mom had filed a routine petition for rehearing, something almost never granted. The court sat on the petition and then, rather than grant that petition, it released a ruling on its own vacating the earlier judgment and issuing a new opinion,” saying that she could file for visitation. There will still be a trial to determine the extent of that visitation.
